4. Course Enrollment and Fees

Enrolling in a course at Apex Academy requires payment of the specified course fee. All fees are listed in US dollars and are subject to change. By enrolling in a course, you agree to pay all applicable fees and taxes. We offer various payment options, including credit card, debit card, and PayPal. All payments are processed securely through our payment gateway provider, Stripe. Apex Academy reserves the right to cancel or reschedule a course due to low enrollment or other unforeseen circumstances. In such cases, you will be entitled to a full refund of the course fee.

5. Refund Policy

Apex Academy offers a 30-day money-back guarantee for most of our courses. If you are not satisfied with a course, you may request a refund within 30 days of your enrollment date. To request a refund, please contact our customer support team at [email protected]. Refunds will be issued to the original payment method. Certain courses may be subject to a different refund policy, which will be clearly stated on the course description page. Please note that we do not offer refunds for courses that have been completed or for which you have received a certificate of completion.

6. Intellectual Property

All content included on the Services, such as text, graphics, logos, images, audio clips, video clips, and software, is the property of Apex Academy or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the content without our prior written consent. 9. Indemnification

You agree to indemnify and hold harmless Apex Academy, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Services or your violation of these Terms. This includes, but is not limited to, claims arising from your content, your conduct, or your infringement of any intellectual property rights.

10. Course Completion Criteria

To successfully complete a course at Apex Academy and receive a certificate of completion, students must meet the following criteria:

  1. Achieve a minimum score of 70% on all graded assignments and quizzes.
  2. Participate actively in the course's discussion forums, contributing at least three substantive posts per week.
  3. Submit all required projects by the specified deadlines.
  4. Complete the final exam with a passing grade of 75% or higher.

Apex Academy reserves the right to modify these criteria at any time. Any changes will be communicated to enrolled students via email and posted on the course website.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or in connection with these Terms shall be brought exclusively in the state or federal courts located in San Francisco, California, and you consent to the jurisdiction of such courts.

12. Changes to Terms

Apex Academy reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and by sending you an email. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically for any updates or modifications.

13. Student Code of Conduct

At Apex Academy, we are committed to fostering a positive and inclusive learning environment. All students are expected to adhere to the following code of conduct:

  • Treat all instructors, staff, and fellow students with respect and courtesy.
  • Refrain from any form of harassment, discrimination, or bullying.
  • Maintain academic integrity by submitting original work and properly citing sources.
  • Respect the intellectual property of others.
  • Participate constructively in course discussions and activities.

Violations of the student code of conduct may result in disciplinary action, including suspension or expulsion from Apex Academy.

14. Course Content Usage

All course materials provided by Apex Academy, including videos, lectures, quizzes, assignments, and projects, are intended for the personal use of enrolled students only. Students are strictly prohibited from:

  • Sharing course materials with individuals who are not enrolled in the course.
  • Reproducing or distributing course materials without the express written consent of Apex Academy.
  • Using course materials for commercial purposes.
  • Modifying or creating derivative works based on course materials.

Any unauthorized use of course materials may result in legal action.

15. Cancellation and Termination

Apex Academy reserves the right to cancel or terminate a student's enrollment in a course for violations of these Terms and Conditions, including but not limited to:

  • Failure to comply with the Student Code of Conduct.
  • Academic dishonesty, such as plagiarism or cheating.
  • Non-payment of course fees.
  • Disruptive behavior that interferes with the learning environment.

In the event of cancellation or termination, the student may not be eligible for a refund.
